New Court Forms
December 18, 2009 (Denver, CO): In a historic first, the State Court Administrator's office has created a form for statewide use which will allow members of the adoption triad and their families to request records through the court system.
The new form JDF 532, along with a user-friendly set of instructions, lists reasons for direct access to records as provided by Colorado law and the Indian Child Welfare Act in a simple check-off format. If a petitioner wishes to make a request for reasons not listed on the form (such as medical necessity) based upon an argument for "Good Cause," they can also use this form, attaching documentation and a copy of the JDF 533, the Order for Good Cause. Previously, the only online forms available (JDF 340-353) involved a request for a Confidential Intermediary , a court-appointed third party who has access to adoption and relinquishment files and, for a fee, performs a search on behalf one party. If the sought party consents, then the CI puts the parties in touch with each other, or simply acts as a conduit for information they may wish to exchange. Note: Colorado Confidential Intermediary Services (CCIS) has reported that they have been receiving JDF 532 (records request) forms in error. Please be sure to file the correct form with the court if you are requesting a CI search.
In addition, in November, 2009 the Colorado Department of Human Services approved a rule in compliance with the Court of Appeals Ruling, allowing state and county agencies, maternity homes and adoption agencies under the jurisidiction of the CDHS to release records to adult adoptees if the adoption was finalized between July 1, 1951 and July 1, 1967.
